This page from JP Boyd on Family Law, along with others that appear highlighted in orange, explains trial procedure and litigation in family law matters before BC courts. These pages are currently undergoing an editorial review and rewrite so as to include more thorough, up-to-date, and practical guidance for readers. Procedures, forms, and laws have changed a lot since 2020, and while the information on these pages have been revised to eliminate gross inaccuracies, some of the information is not as detailed as the editors would like it to be, and some information might still be outdated. The testing of the claims in a court proceeding at a formal hearing before a judge with the jurisdiction to hear the proceeding. The parties present their evidence and arguments to the judge, who then makes a decision resolving the parties' claims against one another that is final and binding on the parties unless successfully appealed. In law, the re-examination of a term of an order or agreement, usually to determine whether the term remains fair and appropriate in light of the circumstances prevailing at the time of the review.
